M.G. Oil Pleads No Contest To Selling 85 Octane Gas

A Rapid City fuel provider, charged in Beadle County with selling 85 Octane gasoline in pumps labeled 87 has pleaded No Contest to the charges. M.G Oil’s attorney, Ed Carpenter entered No Contest pleas to five of the six charges of selling mislabeled fuel at the five Corner Pantry stores in Huron and selling mislabeled fuel to the 281 Travel Center in Wolsey. One of the charges was dropped per the plea deal with the Beadle County States Attorney’s Office. The plea agreement also says that the States Attorney’s office will file no further charges against M.G. Oil in relation to the delivery of mis-labled fuel. M. G. Oil was fined 500-dollars on each of the charges resulting in a fine of 2500-dollars. Magistrate Judge Lee Ann Pierce also sentenced the company, which Carpenter estimates to have around 500 statewide employees, to 100 hours of community service. Pierce said the community service should be “reasonable charitable”.  Pierce gave the company 10 days to pay the fine. The 281 Travel Center in Wolsey is fighting the single charge of selling mis-labeled fuel against it. Owner Robert McGillvray has pleaded not guilty to the charge.
