Performance Radio Contest Rules

These rules apply to all contests operated by any Performance Radio station (KOKK, KJRV or KIJV) live on-air , or on-line, including on www.bigjimrocks.com, www.kijv.com or www.performance-radio.com and where you can enter or participate in a Performance Radio branded contest or giveaway via Facebook, Twitter or any other third party service or site (a “Third Party Service”), except where there are specific rules for a particular contest (a “Performance Radio Contest”).

By entering a Performance Radio Contest, you agree to be bound by these Contest Rules. Details of the prize(s) available to be won, the start and end dates and/or times, and any other information relevant to entering, participating or winning will be identified on the Website, via the Third Party Service and/or by the on-air host, as applicable, for each Performance Radio Contest.

Unless otherwise stated for any Performance Radio Contest, there is a limit of one entry per person per day. Unless otherwise stated, Performance Radio Contests are open to all legal American residents who have reached the age of majority. If the contest is open to minors, for any contestant who has not reached the age of majority, parent or guardian consent is necessary to enter a Performance Radio Contest.

Where appropriate, the terms “contestant” and “winner” mean parent or guardian of that person. Employees of Performance Radio, such employees’ immediate family (father/mother, brother/sister, son/daughter) or persons living under the same roof are not eligible to enter any Performance Radio Contest. To enter for a chance to win a Performance Radio Contest, follow the instructions given on the Website, via the Third Party Service, or by the on-air host (as applicable) to find out how to enter and win a prize.

For Performance Radio call-in contests, you will be required to call in to the local radio station running that particular Performance Radio Contest at the time and follow the instructions of the on-air host or an employee or that answers the phone.

For contests where the winner is selected by a draw, a random draw will be made by a Performance Radio representative from all qualifying entries made by the contest deadline. Selected contestant(s) will be contacted using the contact information provided at the time of entry (eg. telephone number, email address, twitterhandle or Facebook account).

If a selected contestant cannot be reached or qualified using the information provided at the time of entry within three business days (or such other time as notified on the Website or on-air), declines the prize, or fails to to return any required release form, the prize shall be forfeited and Performance Radio has the right, at its sole discretion, to select another winner.

For Performance Radio Radio call-in contests, Twitter giveaways or any other Performance Radio Contest where the winner is responsible for picking up the prize, the prize must be picked up within 30 days or it shall be forfeited and Performance Radio has the right, at its sole discretion, to select another winner.

Potential winners may be required to furnish proof of identification. Winner(s) may also be required to sign a release declaring their eligibility as stipulated in these rules; and releasing Performance Radio, any sponsor or prize donor and their directors, officers and Contest Rules – Generic Rules for Radio, Facebook and Twitter – 2015 2 employees (the “Contest Parties”) from all liability for any damage or loss arising from participation in the contest or from the awarding, acceptance or use of the prize.

Prizes shall be accepted as is and may not be exchanged or refunded for an amount of money, sold or transferred. No substitutions will be allowed. Any unused portion of a prize will be forfeited. If the prize cannot be awarded as described in these rules, Performance Radio reserves the right to substitute a prize or prize component with another of comparable value, as determined in its sole discretion. Refusal to accept the prize releases the Contest Parties from any obligation toward the winner.

If a contestant makes any false statement, (s)he will be automatically disqualified from the Contest. Winners agree that Performance Radio may use their name, image and/or voice for advertising purposes related to a Performance Radio Contest free of charge.

The Contest Parties assume no liability for any loss, damage or injury, including without limitation: (i) lost, stolen, delayed, damaged, misdirected, late, destroyed, illegible or incomplete entries; (ii) loss, theft or damage to software or computer or telephone data, including any breach of privacy; (iii) fraudulent calls; (iv) inability of any person to participate in the Contest for any reason including mistaken addresses on mail or e-mail; technical, computer or telephone malfunctions or other problems with computer on-line systems, servers, access providers, computer equipment, or software; congestion on the internet or at any website, or any combination of the foregoing; (v) damage to any person’s computer, including as a result of playing or downloading any material relating to the Contest; (vi) any delay or inability to act resulting from an event or situation beyond their control, including a strike, lockout or other labour dispute at their location or the locations of the organizations and businesses whose services are used to administer the Performance Radio Contest; (vii) any injury, damage or loss arising from participation in the Performance Radio contest or from the awarding, acceptance or use of any prize, or (viii) prizes that are lost, damaged or misdirected during shipping. Performance Radio reserves the right to cancel or suspend the Performance Radio Contest should a virus, bug or other cause beyond their reasonable control corrupt the security or proper administration of the Performance Radio Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of the Performance Radio Contest is a violation of criminal and civil laws. Should such an attempt be made, Performance Radio reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

All personal information, such as name and contact information, required to enter a Performance Radio Contest is collected by Performance Radio solely for the purposes of administering the Performance Radio Contest and shall not be used for any other purpose without your express consent. By providing this information, you consent to it being used for the stated purposes.

Contest Rules – Generic Rules for Radio, Facebook and Twitter – 2015 3 Performance Radio Contests are not sponsored, endorsed by or administered by Facebook, Twitter or any other Third Party Service. By entering any Performance Radio Contest, all contestants release all Third Party Services from any liability in connection with such Performance Radio Contest. If the identity of a contestant is disputed, the authorized account holder of the e-mail address submitted at the time of entry will be deemed to be the contestant. The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder. A selected contestant may be required to provide proof that (s)he is the authorized account holder of the e-mail address associated with the selected entry.

Winners are not elgible to win cash or prizes from Performance Radio again, on air, online or via social media, until 30 days have passed.

All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in the Performance Radio Contest will be the Contest server. Performance Radio reserves the right to amend the Contest Rules or to terminate any Performance Radio Contest at any time without any liability to any contestant. The decisions of Performance Radio with respect to any dispute or issue involving a Performance Radio Contest are final and binding on all contestants.

All winners, by acceptance of the prize, agreed to release radio station, retail partner, which is packed, Inc. WP beverages, LLC, Pepsi-Cola of Madison, Pepsi Co. Inc., Pepsi-Cola company, it’s bottlers their respective partners subsidiaries divisions affiliates suppliers distributors and advertising or promotional agencies from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses of any kind two persons and property which may be sustained in connection with the receipt, ownership, or use of the prize while traveling to, preparing for, and/or participating in any price related activity. Any portion of a prize not excepted by the winner shall be forfeited. WP beverages, LLC nor Pepsi – call the company make any representations or warranties of any kind concerning the appearance, performance, or safety of any prize awarded. The winner shall bear all risk of loss or damage surprise after it’s been delivered. When are must consent to the use of his/her name, voice, picture, or any likeness without compensation for promotional purposes in all media as determined by WP beverages, LLC, PO Box 8006, Madison, WI 53708.
